Agreement
These terms are an agreement between you and Blue Mustang Studios, LLC, a North Carolina limited liability company that operates MarketHop. By creating an account or using MarketHop, you agree to these terms. If you do not agree, please do not use the service.
What MarketHop is
MarketHop is a platform that connects market vendors and market organizers. Vendors build a profile and apply to markets. Organizers post markets, review applicants, and manage their lineups.
MarketHop is not a party to the agreement between an organizer and a vendor. We do not run the markets, set their rules, or guarantee that a vendor will be accepted or that a market will take place. Decisions about applications belong to the organizer.
Your account
You are responsible for the information you provide and for activity on your account. Keep your details accurate and your login secure. You must be at least 18 years old to use MarketHop.
Acceptable use
You agree not to:
- Use MarketHop for anything unlawful or fraudulent.
- Misrepresent who you are or what you sell.
- Interfere with the service, attempt to break its security, or misuse other people's information.
Payments and fees
Booth-fee payments are processed by Stripe. When a vendor pays a booth fee, the payment is charged on the organizer's connected Stripe account: the organizer is the seller and merchant of record and receives 100% of their booth price. MarketHop's service fee (currently 5%) is added on top of the booth fee and paid by the vendor at checkout, not deducted from the organizer, and each organizer's first market carries no MarketHop fee. MarketHop facilitates the transaction and does not hold the booth-fee funds. Vendors pay the booth fee plus a service fee (which covers MarketHop's fee and card processing) by card and do not need a Stripe account.
Organizers set their own booth fees and, during payout setup, accept the Stripe Connected Account Agreement and the MarketHop Organizer Agreement. You are responsible for any taxes on your own sales and fees.
Refunds and chargebacks
Because the organizer is the merchant of record for booth payments, the organizer is responsible for refunds, chargebacks, and any related fines on their transactions, handled through their own Stripe account according to their own policy. MarketHop is not a party to the booth agreement and does not decide refunds between an organizer and a vendor.
Vendor and organizer responsibilities
Organizers are responsible for their own markets, including fees, rules, selection decisions, and whether an event happens. Vendors are responsible for their products, and for any permits, licenses, or insurance their markets or local laws require.
Your content
You keep ownership of the content you add, such as your profile, product listings, and photos. You grant us permission to host and display that content as needed to operate MarketHop, for example showing your application to an organizer.
Service provided as is
MarketHop is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error free, or that it will produce any particular result.
Limitation of liability
To the extent allowed by law, Blue Mustang Studios, LLC is not liable for indirect, incidental, or consequential damages arising from your use of MarketHop. Our total liability for any claim is limited to the amount you paid us, if any, in the twelve months before the claim.
Termination
You can stop using MarketHop and delete your account at any time. We may suspend or end access for accounts that violate these terms or misuse the service.
Governing law
These terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules.
Changes to these terms
We may update these terms from time to time. When we do, we will change the date at the top of this page. Continuing to use MarketHop after a change means you accept the updated terms.
